1. TERMS & CONDITIONS / TERMS OF USE (INDIA)
These Terms & Conditions ("Terms") govern your access to and use of whizzo.ai ("Whizzo AI," "we," "our," or "us"), an AI-powered learning platform (the "Platform"), owned and operated by Alphacoders Software Innovations Private Limited, a company incorporated under the Companies Act, 2013, having its registered office in Maharashtra, India.
By downloading, accessing, registering on, or using the Platform/App, you agree to be legally bound by these Terms, the Privacy Policy, Fair Usage Policy, and other policies incorporated by reference under the Information Technology Act, 2000 and applicable Indian laws. If you do not agree, you must not use the Platform.
1.1. Eligibility • You must be at least 13 years old to use the Platform. • If you are under 18 years, you represent and warrant that you have obtained verifiable consent from a parent or legal guardian. • You must be legally competent to contract under the Indian Contract Act, 1872. • You are responsible for ensuring compliance with school, examination board, or institutional rules.
1.2. Platform Purpose • Whizzo AI provides AI-assisted educational features including personalized tutoring, study plans, learning analytics, and recommendations. • No Guarantee: Whizzo AI does not guarantee grades, exam scores, admissions, employment, rankings, certifications, or academic outcomes.
1.3. Accounts & Security • Users are responsible for maintaining confidentiality of credentials. • Users must provide accurate and complete information. • All activities under an account are deemed to be performed by the account holder. • You agree to notify Whizzo AI immediately of any unauthorized access or breach of security.
1.4. Acceptable Use Users shall not: • Violate any applicable law, regulation, or government order. • Reverse engineer, decompile, scrape, exploit, probe, or disrupt systems or AI models. • Use the Platform for cheating, impersonation, fraud, or academic misconduct. • Upload infringing, illegal, harmful, defamatory, obscene, or malicious content. • Use bots, automation, or scripts without written consent.
1.5. AI Outputs & Limitations • AI outputs are probabilistic, non-deterministic, and may be inaccurate. • Users must independently verify critical information. • Whizzo AI is an assistive tool and not a substitute for teachers, institutions, professionals, or certified curricula.
1.6. Third-Party Content, Search, Images & YouTube • Whizzo AI may link, display, retrieve, or reference third-party content for educational purposes. • All third-party IP remains with respective owners and use of third-party content is governed by their respective licenses and terms and Indian Copyright Act, 1957 and its amendments. • Whizzo AI disclaims responsibility for accuracy, legality, or availability of external content. • Fair use / Fair dealing principles for education and research under Indian Law apply. • YouTube content is governed by YouTube/Google LLC policies. Whizzo AI is not affiliated unless expressly stated.
1.7. Subscriptions, Billing & Refunds • Certain features may require paid subscriptions. Subscriptions may auto-renew unless cancelled. • Payments may be processed via third-party gateways. • Refunds shall be governed by the Consumer Protection Act, 2019 and applicable rules. • Disputes related to payment gateways shall be governed by their respective terms.
1.8. Suspension & Termination • Whizzo AI may suspend or terminate access for breach, misuse, fraud, or legal compliance. • Termination may occur without notice in cases of serious violations.
1.9. Disclaimers • The Platform is provided on an "as is" and "as available" basis. • No warranties of accuracy, reliability, fitness for purpose, or availability.
1.10. Limitation of Liability • To the maximum extent permitted under Indian Law, Whizzo AI shall not be liable for indirect, incidental, consequential, punitive, or special damages. • Total liability shall not exceed the amount paid by the user in the preceding 12 months.
1.11. Indemnification Users agree to indemnify, defend, and hold harmless Whizzo AI, its directors, officers, employees, and affiliates from any claims, damages, losses, or liabilities arising from misuse, breach, or illegal conduct.
1.12. Governing Law & Jurisdiction Primary Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Courts at Pune, Maharashtra, India shall have exclusive jurisdiction.
